Terms and conditions

GENERAL REQUIREMENTS

1.1) In these terms and conditions, unless the context otherwise requires: “We” or “Company” or “Watch battery replacement & repair (Wbrr)" means [Watch Repair and Restoration LTD]. “You” or “Customer” refer to the person or persons sending a watch, jewellery or other item or items containing gold, platinum, silver, titanium, and other precious metals, gemstones (including and not limited to diamonds, rubies, sapphires and emeralds), or any combination thereof (hereinafter referred to as “Merchandise”) for any repair to, Wbrr.

1.2) These terms and conditions shall be governed by the laws of England and Wales. No failure of Wbrr to exercise or enforce any right or provision of these terms and conditions will not be deemed as a waiver of such right or provision. OWNER OF MERCHANDISE

2.1) Every customer must be at least 18 years of age in order to sell Merchandise to Wbrr. Every customer must be the actual legal owner of all watches, jewellery and other Merchandise sold or attempted to be sold to Wbrr. Every customer must be acting on his or her own behalf and not as the agent or representative of another person. You must be domiciled in the United Kingdom.

2.2) The customer guarantees all of the following: that no Merchandise sent to us are the result of illegal activity in the UK or any other country; the Merchandise is sold free of liens, encumbrances, liabilities, and adverse claims of every nature and description whatsoever; that any transaction initiated by the customer will not cause Wbrr to be in violation of any anti-money laundering, anti-terrorism, or other applicable law of any country; not to send in any hazardous materials to Wbrr such as arsenic, mercury, lead, tin or any other harmful, or toxic elements.

2.3) You agree that you may have to provide us with proof of identification before we pay you, so that we can meet our legal obligations.

POSTING AND INSURANCE

3.1) All Merchandise sent to Wbrr must be by a carrier that employs a system whereby your shipment can be traced. All Merchandise posted to us by using the Royal Mail Special delivery bag, is at the customer’s own risk until received and signed for by Wbrr. Post office and Courier receipts of sent items to Wbrr must be kept in order to make a claim from either Royal mail or the Courier.

3.2) You must list the Merchandise you are sending us on the form provided and you need to complete your details in full and sign the Customer Declaration. Wbrr reserves the right to reject any forms (and the Merchandise they are sent with) which are not properly completed and signed. Wbrr also reserves the right to reject delivery of any package which appears to be opened, damaged, or tampered with in any way. Any such packages we reject will be returned to you – at our cost – but without any liability to Wbrr.

3.3) In no event or circumstance will Wbrr be liable to any third parties or insurance carriers, nor will Wbrr be liable for any consequential or indirect loss, whilst not in receipt of the Merchandise.

RECEIPT OF MERCHANDISE

4.1) We will record the opening and the contents of each Watch Pack or parcel sent to us. We will retain the footage for 10 days after we receive the package. You may request a copy of the video for an additional fee.

OUR OFFER

6.1) Upon completing our initial diagnosis of the Merchandise, if able, we will give you a fixed quote or an estimation. We will inform you of this or notify you of this by the method you have indicated to us. If the merchandise has been left tin our care and we fail to make contact initially, we will keep trying and will keep your goods in a secure place such as a safe, in the meantime.

6.2) If you do not agree with the quote, we will hand back or send back your Merchandise at your address as it appears in our records via the shipping method of our choosing, at your expense and within 5 working days.

6.3) If after 28 days we have been unable to contact you, you will be charged a store fee. If after 56 days the merchandise has not been collected, we reserve the right to dispose of the merchandise as we see fit.

6.4) All repairs are final. No refunds are permitted. Once the work has been done to the standard we set, we will deem your prior acceptance as legally binding on both of us and it is irrevocable.

LIMITATION OF LIABILITY

8.1) This limitation of liability shall be binding on each and every customer and any third party, including, but not limited to, the customer and the customer’s successors, assigns, insurance carriers and any other individual or entity asserting any right or claim relating to customer’s transaction with Wbrr

8.2) No liability will be accepted for loss or damage resulting from the use of services offered by Wbrr, and in no event shall Wbrr be liable to any third party, including any insurance carrier. Wbrr shall not be liable for any subrogation claim brought by customer’s insurance carrier and, by submitting an item to Wbrr, the customer expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance carrier.

8.3) To the maximum extent permitted by applicable law Wbrr shall not be liable to anyone for any damages, including but not limited to, incidental, consequential, punitive, loss of profit or opportunity.

8.4) Wbrr makes no representations, statements and warranties of any kind that the services provided by us will meet your expectations.

8.5) By submitting the item, the customer explicitly and expressly accepts this limitation of liability as well as the remainder of the terms and conditions.
